EMPLOYER SPONSORED GREEN CARDS / DOL LABOR CERTIFICATION

PERM Labor Certification Lawyer — Prevailing Wage, Recruitment & ETA 9089

Immigration counsel for US companies sponsoring professionals, skilled workers and other employees for permanent residence. Get the job requirements, recruitment and filing record right before submitting to the Department of Labor.

EMPLOYMENT BASED PERMANENT RESIDENCE

What PERM labor certification actually establishes

PERM is the US Department of Labor process through which a sponsoring employer ordinarily demonstrates that it offers a bona fide permanent full time position and has satisfied the applicable wage and labor market testing rules.

Many EB2 and EB3 cases depend on PERM certification before an employer can file Form I-140. A successful process starts with the real job: duties, minimum requirements, worksite and compensation. The recruitment is a genuine opportunity for qualified US applicants, not a formality built around an existing employee.

The Messersmith Law Firm assists US employers with the regulatory requirements, evidence strategy and transition to an immigrant petition. Certification by DOL does not itself grant an immigrant visa, lawful status or employment authorization.

BEFORE RECRUITMENT BEGINS

Four foundations of a compliant PERM case

The position must reflect the employer’s real business requirements and remain consistent throughout the prevailing wage request, labor market test and application.

PERMANENT JOB

Real permanent full time position

The company must offer genuine, nonseasonal full time employment in the United States, with a clearly identified employer, worksite, duties and supervision.

JOB DESIGN

Accurate minimum job requirements

Degree, training, experience, special skills, licenses and alternative qualifications must be lawful, reasonable and reflect the position’s actual minimum needs.

PREVAILING WAGE

Applicable prevailing wage

Request a DOL prevailing wage determination for the occupation and area of intended employment and ensure the offered position and wage evidence are consistent.

LABOR MARKET

Good faith US worker recruitment

Use the correct professional or nonprofessional recruitment sequence and consider US applicants against the real minimum requirements without tailoring the job to the beneficiary.

The legal definition of a professional occupation for PERM recruitment is not identical to every EB2 or EB3 classification. Determine the proper recruitment category before launching advertisements.

FROM JOB DESCRIPTION TO DOL DECISION

The PERM labor certification process: six controlled stages

Employers should treat PERM as a coordinated compliance project. The sequence and timing of wage determinations, advertising, applicant review and filing can determine the outcome.

01

Evaluate the offered position

Confirm business need, actual job duties and minimum requirements, location, alternative qualifications and the proposed EB2 or EB3 pathway.

02

Request the prevailing wage

Prepare ETA 9141 in DOL FLAG, respond to wage classification issues if necessary and confirm a valid determination before filing ETA 9089.

03

Conduct recruitment and notice

Schedule advertisements, the state workforce agency job order, additional professional steps when applicable and workplace notice within regulatory windows.

04

Review US applicants in good faith

Record recruitment responses, use lawful job related standards, interview when appropriate and prepare an accurate recruitment report.

05

File ETA Form 9089

Reconcile occupation, worksite, wages, requirements, dates, employer information and beneficiary qualifications before electronic submission.

06

Address DOL outcome and plan I-140

Prepare for audit or supervised recruitment if directed. After approval, observe the 180 day labor certification validity period for USCIS filing.

ETA FORM 9141 AND WAGE STRATEGY

Prevailing wage determinations must match the actual job

A wage determination depends on the occupation, geographic work location, duties, supervisory responsibilities and education or experience requirements. Mistakes early in this process can carry into recruitment and Form ETA 9089.

JOB ANALYSIS

Duties and occupational code

Describe the position as it will actually be performed. Unusual duties or combinations of responsibilities may affect occupational classification and wage assessment.

GEOGRAPHY

Worksites and remote arrangements

Evaluate where work will take place, including telecommuting, multiple worksites or changes in location. PERM location representations affect the wage and recruitment strategy.

FILING TIMELINE

Valid wage before certification filing

Use a valid prevailing wage determination and manage its validity, recruitment initiation and application filing dates under applicable rules.

DOL uses the Foreign Labor Application Gateway (FLAG) for ETA Form 9141 and ETA Form 9089. A prevailing wage request alone does not complete the PERM process.

THE PERM LABOR MARKET TEST

Professional and nonprofessional PERM recruitment are different

The precise recruitment structure is regulated. Employers should not assume that a newspaper advertisement or a generic online posting satisfies every requirement.

PROFESSIONAL

Professional occupations

The standard professional track ordinarily involves a state workforce agency job order, two Sunday newspaper advertisements or an allowed substitute, and three additional methods chosen from the regulatory list.

NONPROFESSIONAL

Nonprofessional occupations

Standard nonprofessional recruitment generally uses a state workforce agency job order and two Sunday newspaper advertisements. Other general obligations remain applicable.

WORKSITE NOTICE

Notice of filing

Employers must address the worksite posting or bargaining representative notice and any in house media requirements, including the regulated notice period and mandatory content.

Recruitment generally must occur within the regulatory 30 to 180 day period before filing, with additional specific timing rules and limited exceptions. The state job order ordinarily runs for 30 days. Failure to observe sequencing can require restarting recruitment.

GOOD FAITH APPLICANT EVALUATION

How employers must evaluate US workers during PERM recruitment

PERM does not permit automatically disqualifying a US applicant simply to favor the sponsored employee. Applicants must be considered against lawful, job related minimum qualifications and the employer must document its decisions.

US APPLICANTS

Fair review of resumes and applications

Assess whether a US worker meets stated minimum requirements or could acquire skills through reasonable on the job training, as applicable.

UNUSUAL REQUIREMENTS

Defensible business necessity

Requirements exceeding normal occupational standards, foreign language demands and unusual combinations of skills may require detailed business justification.

AUDIT FILE

Reliable recruitment report

Summarize the steps, applicant pool, hires and lawful job related reasons for rejection. Retain the evidence supporting every material assertion.

Read 20 CFR 656.17 recruitment and job requirements ↗

JOB REQUIREMENTS AND PRIOR EXPERIENCE

Alternative qualifications, employer experience and business necessity

An otherwise legitimate business can experience PERM difficulty if its minimum requirements are written around one employee or contradict what the company actually required in the past.

TRUE MINIMUMS

Actual minimum requirements

Examine prior hires, hiring history, comparable roles, and whether the stated degree, skill or experience threshold is actually needed.

PRIOR EXPERIENCE

Experience gained with the sponsor

Review whether earlier work with the sponsoring employer was in a substantially comparable position and whether applicable regulatory exceptions permit using it.

ALTERNATE PATHS

Alternative requirements and Kellogg

Where alternative education or experience combinations are offered, examine substantial equivalence, applicable Kellogg wording and whether the foreign worker is objectively qualified.

A job specification cannot be evaluated solely by the sponsored worker’s resume. The position must remain a legitimate opportunity open to qualified US workers.

WHO PAYS FOR PERM

PERM recruitment and employer legal fees generally cannot be shifted to the worker

Employer compliance includes proper allocation of recruiting, preparation and representation expenses. The Department of Labor restricts seeking or receiving payment for employer activities related to the labor certification.

EMPLOYER RESPONSIBILITY

Recruitment expenses

The sponsoring employer generally must pay its PERM advertisements, recruitment activities and other required employer labor certification costs.

LEGAL FEES

Attorney fees for employer representation

The sponsored employee generally cannot reimburse employer PERM counsel fees through a separate agreement, wage deduction or indirect arrangement.

INDIVIDUAL COUNSEL

Separately retained employee counsel

Different rules can apply to a worker’s independent legal representation and to subsequent USCIS stages. The representation arrangement and actual services matter.

The employer must not treat PERM expenses as a recoverable employee benefit, or seek a kickback, salary concession or other prohibited consideration. See 20 CFR 656.12.

PROTECT THE RECRUITMENT RECORD

PERM audits, supervised recruitment and retention requirements

A filing is more defensible when the employer maintains contemporaneous supporting records rather than attempting to recreate them after an audit notice.

RECRUITMENT FILE

Audit ready documentation

Retain advertisements, job order details, notice records, recruiting methods, applications, correspondence, lawful rejection decisions and signed report.

DOL OVERSIGHT

Supervised recruitment response

When directed by DOL, follow the specific supervised recruitment rules, advertisements, applicant handling and response deadlines.

RECORD KEEPING

Five year record retention

PERM documentation generally must be retained for five years after filing under the regulation, even when the employer does not upload every supporting document initially.

DOL can audit cases that otherwise appear properly filed. The question is not simply whether anyone applied, but whether the job, recruitment and representations satisfy the rules.

OCTOBER 2026 DOL PROCESSING REFERENCE

How long does PERM labor certification take?

There is no universal PERM completion date. Employers must plan for the prevailing wage queue, recruitment timeline, DOL adjudication and potentially audits before any I-140 or green card processing.

PWD: SEP 30

Prevailing wage queue

As of September 30, 2026, DOL lists PERM prevailing wage requests from June 2026 in its processing queue. This is a dated workload snapshot.

DOL: OCT 5

PERM analyst queue

As of October 5, 2026, DOL lists PERM analyst review of cases filed in December 2025. Individual processing may be shorter or longer.

AUG 2026

Published average determination

DOL’s most recent August 2026 analyst determination average was 336 calendar days. That is an average of decisions made, not a guaranteed time for a new application.

Updated for October 13, 2026. These agency statistics are historical reference points. Confirm the current DOL processing queues and do not rely on old claims about filing within 37 days or short guaranteed adjudication.

FROM CERTIFICATION TO GREEN CARD

After PERM approval: Form I-140, priority dates and permanent residence

DOL certification usually establishes one necessary step for a qualifying employment based immigrant petition. USCIS must separately assess the employer, worker, job classification and evidence.

DEADLINE

180 day certification validity

The employer generally must submit Form I-140 to USCIS while the approved labor certification is valid, ordinarily within 180 calendar days after DOL approval.

I-140

EB2 or EB3 immigrant petition

The appropriate category depends on the job’s regulatory requirements and beneficiary credentials. USCIS may review ability to pay and whether the worker met the certified qualifications.

GREEN CARD

Priority date and visa availability

The DOL filing date is generally the priority date for ordinary PERM based petitions. Adjustment or consular processing depends on visa availability, admissibility and individual eligibility.

WHEN PERM MAY NOT BE REQUIRED

NIW, Schedule A and special handling should be reviewed separately

Not all employment based immigrant categories follow standard professional or nonprofessional PERM recruitment. Employer and worker strategy should start with identifying the correct legal path.

NIW

EB2 National Interest Waiver

Qualifying NIW applicants can obtain a waiver of the usual job offer and labor certification requirements under the statutory standard; employer sponsorship may be unnecessary. NIW information ↗

SCHEDULE A

Schedule A nurses and physical therapists

Qualifying professional nurses and physical therapists have a separate Schedule A filing framework and do not undergo standard PERM recruitment. Schedule A guide ↗

SPECIAL HANDLING

University teacher special handling

Eligible college and university teaching positions may use distinct competitive recruitment and timing under 20 CFR 656.18; the institution must document the process accurately.

An exemption from ordinary PERM recruitment does not mean automatic green card eligibility or exemption from the relevant wage, notice or immigrant petition rules.

EMPLOYER COMPLIANCE RISKS

Common reasons a PERM filing is delayed, audited or denied

The most expensive problems often arise before ETA Form 9089 is submitted. An early legal review can identify procedural defects that cannot easily be repaired after a recruitment campaign.

CONSISTENCY

Conflicting duties or requirements

Wage request, recruiting ads and ETA 9089 contradict one another, or minimum qualifications appear built around a particular employee.

RECRUITMENT

Missing or untimely recruitment

Job order, two Sunday advertisements, posting notice, required professional steps or 30 to 180 day windows are defective.

COMPLIANCE

US applicant or wage problems

The employer cannot substantiate rejections, overlooks layoffs, shifts recruiting costs or misstates wage and geographic facts.

PETITION STRATEGY

I-140 planning overlooked

The position and category do not fit EB2/EB3 requirements or the employer cannot provide later wage ability evidence.

THE MESSERSMITH LAW FIRM

PERM legal representation for sponsoring US employers

The firm can help employer stakeholders coordinate immigration strategy and regulatory compliance without treating labor certification as a simple form preparation task.

PERM QUESTIONS ANSWERED

PERM labor certification: 36 frequently asked questions

Clear answers about PERM wage determinations, professional recruiting, job requirements, employer costs, audits, prevailing wage, processing times and the EB2/EB3 green card pathway.

01What is PERM labor certification?

PERM is the Department of Labor permanent labor certification process that US employers ordinarily use before certain EB2 and EB3 immigrant worker petitions. DOL evaluates a bona fide permanent full time job, the prevailing wage, the recruitment effort and whether qualified, available and willing US workers can fill the job. Certification is not a green card.

02Who files PERM, the employer or the employee?

The US sponsoring employer applies for PERM certification and is responsible for its filings, recruitment and compliance. A prospective employee may provide credentials and immigration information, but the job opportunity and recruitment obligations belong to the employer.

03Does the foreign worker have to be working for the employer when PERM is filed?

Generally no. PERM concerns an offered future permanent full time position, not necessarily current employment. The individual must still possess the stated minimum qualifications by the relevant filing date, and separate immigration status concerns may affect later processing.

04What is a prevailing wage determination?

The National Prevailing Wage Center issues a determination for the offered occupation, job requirements and geographic area. Employers generally request it on ETA Form 9141 through the DOL FLAG system and need a valid determination before submitting ETA Form 9089.

05What is ETA Form 9141?

ETA Form 9141 is the prevailing wage request submitted to the Department of Labor. It describes job duties, location, minimum requirements and other factors used to determine the applicable wage.

06What is ETA Form 9089?

ETA Form 9089 is the Application for Permanent Employment Certification. The employer submits it through DOL FLAG after completing the required prevailing wage and recruitment steps. Accuracy across the job requirements, advertisements, dates and recruitment record is essential.

07What is the DOL FLAG system?

FLAG is the Department of Labor’s Foreign Labor Application Gateway used for prevailing wage requests and permanent labor certification applications. Employers and representatives should retain the supporting records beyond the electronic form.

08What recruitment is required for a professional PERM position?

A standard professional case generally requires a 30 day state workforce agency job order, two Sunday newspaper advertisements or an allowed professional journal alternative, plus three additional methods selected from the regulatory list. Posting notice and date restrictions also apply; occupation classification controls the method.

09What recruitment is required for nonprofessional PERM positions?

Ordinary nonprofessional recruitment generally involves a state workforce agency job order for 30 days and two Sunday newspaper advertisements, together with required notice of filing and the other applicable rules. The additional three professional recruitment methods are not automatically required for a nonprofessional position.

10What is the PERM notice of filing?

A covered employer normally must provide notice of the proposed permanent labor certification filing at the worksite, including posting for at least 10 consecutive business days and compliance with the prescribed 30 to 180 day timing. Bargaining representative and in house media notice rules may also apply.

11Why do employers place two Sunday newspaper advertisements?

For ordinary PERM recruitment the regulations generally require two Sunday advertisements in an appropriate newspaper of general circulation, with a permitted professional journal substitute under specific conditions. Their content and publication dates must align with the actual job and other recruitment.

12What is the 30 day waiting period before filing PERM?

The PERM recruiting rules generally impose a period of at least 30 days after required recruitment before filing, with specific exceptions for one permitted additional professional recruitment step. Notice and recruitment must be conducted within the statutory timing windows, not treated as an informal checklist.

13Can an employer reject US workers because it prefers the sponsored employee?

No. PERM recruitment must be a genuine test of the labor market. The employer must assess applicants against its lawful actual minimum requirements; a US applicant cannot be rejected merely because the employer prefers the foreign worker or because the applicant could learn skills through reasonable on the job training.

14What are the employer’s actual minimum requirements?

The job requirements must reflect what the employer truly requires for that position and generally cannot be inflated or tailored to the sponsored employee. DOL restrictions on experience with the employer, substantially comparable positions, and business necessity must be analyzed where relevant.

15Can PERM require a foreign language or unusual skills?

Potentially, but requirements exceeding what is normal for the occupation must meet applicable business necessity standards. Foreign language and other special requirements receive scrutiny and should be supported by a genuine, documented operational need.

16What are alternative PERM job requirements and the Kellogg rule?

When an employer offers alternative combinations of education, training or experience, DOL requires a careful evaluation of whether the alternatives are substantially equivalent and whether the foreign worker meets them. Where applicable the Kellogg language and the regulations governing alternative requirements must be addressed accurately.

17Can the worker use experience gained with the sponsoring employer?

Sometimes, but 20 CFR 656.17 generally restricts using experience gained with the petitioning employer if it was obtained in a substantially comparable position, subject to the relevant exceptions. Duties, prior positions, employment dates and the employer’s true minimum requirements require careful review.

18Does PERM require the employer to pay the advertising and attorney fees?

The employer must bear costs that DOL prohibits transferring to the sponsored worker, including PERM recruitment expenses and the employer’s labor certification attorney fees. The narrower rules for separately representing a worker and later USCIS stages must be evaluated without disguised reimbursement or wage deductions.

19What documents should the employer retain after PERM recruitment?

Retain the prevailing wage determination, advertisements, job order records, posting and in house notices, proof of additional recruitment, applications and resumes, applicant evaluation, lawful rejection reasons and recruitment report. DOL generally requires records to be retained for five years from filing.

20What is a PERM recruitment report?

The employer prepares and signs a report describing recruitment undertaken, applicants, hires and the job related lawful reasons for rejecting US applicants. It is not merely a list of resumes, and it must be supported by the actual recruitment file.

21What happens if the employer had recent layoffs?

Layoffs of US workers in the same or a related occupation in the area of intended employment within the applicable six month window can trigger additional notification and consideration obligations. The analysis is fact sensitive and should occur before launching recruitment.

22What happens if DOL audits a PERM application?

An audit can require the employer to provide the complete recruitment file and evidence substantiating the offered job and requirements. An audit is not itself a denial, but inconsistent documents or missed response deadlines can create serious consequences.

23What is supervised recruitment?

The Department of Labor may direct an employer to conduct recruitment under closer agency supervision, including agency review of advertising and applicant processing. Employers must follow the specific instructions and deadlines imposed in that case.

24Can PERM be denied even if no qualified US workers applied?

Yes. Procedural defects, missing or contradictory recruitment records, improper minimum requirements, invalid timing, wage problems, or inaccurate ETA 9089 representations may cause denial independently of applicant count.

25Can the employer withdraw and refile a PERM application?

Depending on the facts and timing, withdrawal and a new application may be possible, but it can affect the priority date, require new recruitment or prevailing wage documentation and introduce additional risks. The pending case and program rules should be evaluated before acting.

26How long does PERM take in October 2026?

There is no fixed processing period. As of October 5, 2026, DOL lists analyst review and audit review of cases filed in December 2025, and its most recent published average for August 2026 analyst determinations was 336 calendar days. Prevailing wage and recruitment occur before submission. Always check the current FLAG processing times.

27Does an approved PERM labor certification grant a green card?

No. PERM establishes a labor certification for the offered job. Employers generally must then submit Form I-140 to USCIS, and the sponsored worker must separately qualify for adjustment of status or an immigrant visa when the priority date and other requirements allow.

28When must Form I-140 be filed after PERM approval?

An approved PERM labor certification generally remains valid for 180 calendar days, and USCIS ordinarily must receive the associated Form I-140 during that validity period. Missing this deadline can make the certification unusable.

29What is the PERM priority date?

For an employer sponsored EB2 or EB3 case requiring labor certification, the priority date generally corresponds to when DOL accepts the properly filed labor certification application for processing. Visa availability is then evaluated under the relevant Visa Bulletin category and chargeability area.

30Does the employer need to prove ability to pay the wage?

Ability to pay the proffered wage is typically evaluated at the I-140 immigrant petition stage, including evidence from the priority date onward as required by USCIS. Employers should plan for that financial evidence before initiating PERM.

31Is PERM required for every EB2 green card?

No. Many standard employer sponsored EB2 filings require PERM, but a properly qualified National Interest Waiver can waive the job offer and labor certification requirements. Exceptional ability classification alone does not automatically provide a waiver.

32Is PERM required for every EB3 green card?

Most ordinary employer sponsored EB3 skilled worker, professional and other worker petitions require PERM. Schedule A qualifying occupations, including professional nurses and physical therapists, follow a different labor certification procedure without ordinary PERM recruitment.

33Does Schedule A mean that no labor certification rules apply?

No. A qualifying Schedule A employer generally files the prescribed labor certification materials with USCIS instead of undergoing ordinary DOL supervised PERM recruitment. Notice, prevailing wage, classification and evidence requirements must still be addressed.

34What is special handling PERM for university teachers?

Certain college or university teaching positions may qualify for special handling under 20 CFR 656.18 based on a competitive recruitment and selection process, with distinct documentation and filing deadlines. Do not assume the standard PERM recruitment steps apply in those cases.

35Can the foreign worker change jobs during a PERM process?

A change of sponsoring employer or the offered permanent position can affect an ongoing PERM and may require a new process. Later AC21 portability rules are separate and generally arise only after qualifying adjustment filings meet statutory conditions.

36Why hire a PERM labor certification attorney for an employer-sponsored green card?

A lawyer can assess job requirements, lawful recruitment, advertising schedules, PERM cost rules, documentation, ETA Form 9089 accuracy and audit readiness, then align the certified job with the later I-140 and permanent residence process. Early legal review can reduce avoidable errors; results depend on the facts.
