EMPLOYMENT BASED IMMIGRATION / EB2 NIW

National Interest Waiver for Business, Technology, Health and Education

A detailed guide to NIW petitions for entrepreneurs, executives, software engineers, healthcare professionals, educators and others whose proposed work serves the United States.

THE EB2 NATIONAL INTEREST WAIVER

An immigration strategy centered on the proposed work

For many applicants outside academia, the decisive question is not how many articles they have published. It is whether the evidence establishes the national importance of their particular proposed endeavor and their ability to advance it.

01 / CLASSIFICATION

Qualify for EB2

Show eligibility as an advanced degree professional or a person of exceptional ability. A credential or job title alone does not establish an NIW.

02 / NATIONAL INTEREST

Prove the three prongs

Explain substantial merit and national importance, demonstrate that the applicant is well positioned, and show why the waiver benefits the US.

03 / IMMIGRATION PROCESS

Request a job offer waiver

A qualifying NIW generally permits self petitioning without a permanent job offer or PERM labor certification. Visa availability and residence processing remain separate.

The standard applies across occupations. Business owners, technology professionals, healthcare leaders and educators must still document the specific work they propose to undertake, its prospective effects, and a credible plan.

THE LEGAL FRAMEWORK

What an ordinary NIW petition must establish

The underlying EB2 classification and the discretionary national interest waiver are separate eligibility inquiries. The three prongs come from Matter of Dhanasar, 26 I&N Dec. 884 (AAO 2016).

PRONG 01

Substantial merit and national importance

Describe the specific endeavor, the real problem it addresses, and its potential broader implications. Importance of an industry or employer alone is insufficient.

PRONG 02

Well positioned to advance the work

Connect relevant education, experience, achievements, outside interest, resources and a credible future plan. Success need not be guaranteed.

PRONG 03

On balance, a waiver benefits the US

Explain why the individual and proposed work justify waiving the ordinary job offer and labor certification framework, considering the practical circumstances.

Advanced degree or exceptional ability

The advanced degree route may be based on an eligible higher degree or a bachelor’s degree plus at least five years of progressive postbaccalaureate specialty experience, with the occupation and its professional nature evaluated under the applicable rules. Exceptional ability requires its own regulatory evidentiary showing and an overall assessment.

The proposed endeavor must be specific

Statements such as “improving technology,” “creating jobs” or “expanding access to healthcare” require concrete objectives, activities, and corroboration. The analysis focuses on what the applicant proposes to do, not merely the ordinary duties of an occupation.

PROFESSION SPECIFIC ANALYSIS

NIW petitions outside traditional research

There is no single qualifying profession or required citation count. The evidence must be matched to the proposed endeavor and the field in which it will be advanced.

ENTREPRENEURSHIP

Entrepreneurs and startup founders

Identify the venture, its market or public need, measurable traction, relevant intellectual property, customers, investment or partnerships, and the founder’s central role. Routine local business activity is not automatically nationally important.

BUSINESS LEADERSHIP

Executives and business professionals

Show the applicant’s actual decisions, business systems, growth, operational improvements, investment, workforce effects or industry adoption. Explain what work will continue in the US and its potential impact beyond a single employer.

TECHNOLOGY

Software engineers and technology professionals

Connect a defined software, cybersecurity, AI, data infrastructure or technical endeavor with implementation plans, production deployment, verified use, independent interest and prospective impact.

HEALTHCARE

Physicians and healthcare professionals

Describe concrete clinical, operational or patient care contributions with supporting records. Ordinary Dhanasar based cases and the separate statutory physician service based NIW have different requirements.

PUBLIC HEALTH

Public health practitioners

Identify measurable programs addressing access to care, disease prevention, population health or health systems, together with evidence of scale, implementation and likely broader effects.

EDUCATION

Educators and education leaders

Document curricula, training models, workforce development, education access or other defined interventions, particularly where adoption and effects extend beyond ordinary classroom teaching.

INFRASTRUCTURE

Engineers and infrastructure specialists

Show defined energy, transportation, manufacturing, resilience, safety or infrastructure work, the applicant’s role in solving a real problem, and verified implementation or credible prospective results.

A DOCUMENTED CASE

Build the record around the legal questions

Publications and scholarly citations can be useful, but they are not universal prerequisites. Business, technology, education and healthcare records may demonstrate impact through very different forms of evidence.

PAST CONTRIBUTIONS

Proven results

Signed contracts, independently verified product use, project outcomes, leadership responsibilities, measurable cost or safety improvements, and documented education or health effects.

FORWARD LOOKING

Feasible US endeavor

Detailed business or operating plans, partners, facilities, funding, prospective users, implementation milestones and evidence connecting the applicant to the intended activity.

EXTERNAL SUPPORT

Independent corroboration

Relevant government materials, third party adoption, outside investors, customers, institutional partners and letters explaining specific contributions rather than repeating praise.

What recommendation letters should explain

The author’s expertise and firsthand knowledge, the applicant’s precise role, corroborated results, the proposed next steps, and why those steps may create benefits beyond ordinary private employment.

What weakens a petition

Generic business plans, unsupported forecasts, unexplained awards, repeating industry statistics, and reliance on the reputation of an employer without showing the applicant’s actual achievements and feasible endeavor.

IMPORTANT PHYSICIAN DISTINCTION

The special physician NIW is a separate statutory route

An ordinary physician may pursue an NIW under Dhanasar where the required showing is supported. Separately, INA §203(b)(2)(B)(ii) establishes a special physician NIW mechanism for qualifying clinical service in designated shortage areas or VA facilities.

SERVICE

Qualifying full time clinical practice

The physician must commit to the required full time practice in an eligible shortage area or qualifying VA facility, with the applicable statutory and policy requirements met.

PUBLIC INTEREST

Agency determination

A federal agency or state public health department with appropriate jurisdiction must determine that the qualifying work is in the public interest. Supporting documentation is essential.

COMPLETION

Aggregate five year service requirement

The statute generally requires five years of qualifying full time physician service before permanent residence can be granted, excluding service in J1 status. Timing and evidence must be assessed individually.

The special physician route is not interchangeable with the regular Dhanasar analysis. Separate issues may arise under J1 waiver rules, licensure, location requirements and evidence of completed service. See J1 visa guidance.

PROFILE AND CASE DEVELOPMENT

A stronger petition connects past work to future national benefit

NIW adjudication is not a contest in the volume of exhibits. Good documentation should make it easy to identify what the individual actually accomplished, what the US endeavor entails, and why the projected benefits are credible.

01

Define the work

Write a specific endeavor statement identifying the planned activities, beneficiaries or users, implementation pathway and foreseeable impact.

02

Verify the record

Gather relevant credentials, accomplishment records, external confirmation, project data, letters and evidence of access to necessary resources.

03

Connect the prongs

Explain how individual exhibits answer each Dhanasar inquiry, including the waiver balance. Avoid submitting an undifferentiated collection of achievements.

QUESTIONS AND ANSWERS

NIW for other fields: 25 frequently asked questions

The following questions reflect the existing business, technology, healthcare, and nonresearch NIW guidance on this page.

01What is the NIW green card?

NIW is a national interest waiver under the EB2 category. It allows certain applicants to seek a green card without a permanent job offer or labor certification if the legal standard is met.

02Who qualifies for NIW?

A qualifying NIW case must first fit the EB2 category and then show that the proposed endeavor has substantial merit and national importance, that the applicant is well positioned to advance the endeavor, and that it would benefit the United States to waive the job offer and labor certification requirements.

03Does NIW require a job offer?

No. NIW does not require a permanent job offer.

04Does NIW require labor certification?

No. NIW does not require PERM labor certification.

05Can I self-petition for NIW?

Yes. NIW may be filed as a self-petition if the applicant can meet the legal standard.

06What is the proposed endeavor in an NIW case?

The proposed endeavor is the future work the applicant plans to carry out in the United States. In non-research cases, this often involves business growth, technology development, healthcare delivery, public health work, education, infrastructure, entrepreneurship, product innovation, or another field-specific contribution with broader national value.

07What does substantial merit mean for NIW?

Substantial merit means the proposed endeavor has real value in an important area such as business development, technology, healthcare, education, infrastructure, public welfare, energy, manufacturing, or another field that matters in the United States.

08What does national importance mean for NIW?

National importance means the proposed endeavor matters beyond one employer, one client, or one local setting and has broader importance for the United States.

09What does well positioned mean for NIW?

It means the applicant has the background, skills, track record, experience, and evidence needed to continue advancing the proposed endeavor successfully in the United States.

10What is the Dhanasar framework?

The Dhanasar framework is the legal standard used in NIW cases. It asks whether the proposed endeavor has substantial merit and national importance, whether the applicant is well positioned to advance it, and whether waiving the job offer and labor certification requirements would benefit the United States on balance.

11Can entrepreneurs qualify for NIW?

Yes. Entrepreneurs may qualify for NIW if the filing shows that the proposed business or venture has substantial merit and national importance and that the applicant is well positioned to advance it.

12Can startup founders qualify for NIW?

Yes. Founder cases can be strong when the proposed endeavor is clearly defined and tied to innovation, job creation, economic growth, technical development, public benefit, or another nationally important goal.

13Can software engineers qualify for NIW?

Yes. Software engineers may qualify for NIW if the petition shows that the proposed work has substantial merit and national importance and that the applicant has the record and skills needed to advance it.

14Can computer scientists and technology professionals qualify for NIW?

Yes. Many technology professionals use NIW when their work can be tied to innovation, infrastructure, cybersecurity, AI, data systems, digital transformation, product development, or other nationally important technical activity.

15Can physicians and healthcare professionals qualify for NIW?

Yes. Healthcare cases may be strong when the filing shows broader impact on patient care, access to care, underserved communities, health systems, public health, or another nationally important medical or healthcare need.

16Can educators qualify for NIW?

Yes. Educators may qualify for NIW if the petition shows that the proposed work has broader value in teaching, workforce development, educational access, training, student outcomes, curriculum leadership, or another nationally important educational area.

17Can public health professionals qualify for NIW?

Yes. Public health cases can be strong when the filing shows importance to disease prevention, health systems, population health, access to care, community health, or another broad public-impact goal.

18Can I qualify for NIW without publications?

Yes. Many non-research NIW cases do not rely on publications. Strong cases may instead focus on leadership, measurable impact, innovation, business growth, healthcare outcomes, educational results, licenses, awards, media recognition, or other field-appropriate evidence.

19Can I qualify for NIW without citations?

Yes. Citations are not required in every NIW case. They are more common in research-based filings, while non-research cases often depend on other forms of recognition, leadership, and measurable impact.

20Do I need major awards for NIW?

No. Major awards are not required. Many strong NIW cases are approved without major awards if the overall evidence is strong and the proposed endeavor is well explained.

21What kinds of evidence are common in non-research NIW cases?

Common evidence includes degrees, licenses, certifications, leadership roles, awards, media recognition, recommendation letters, patents, product development, business results, healthcare or educational impact, public benefit evidence, and documents explaining the proposed endeavor and its national importance.

22Does working at a major company help an NIW case?

It can help if the filing shows that the applicant’s role, achievements, or impact support the proposed endeavor and demonstrate that the person is well positioned to advance nationally important work. The employer’s name alone is not enough.

23Can business results or technical impact help an NIW case?

Yes. Business growth, job creation, product adoption, operational improvements, technical innovation, healthcare outcomes, educational results, or other measurable achievements can be very important when they support the proposed endeavor and its national importance.

24What does an approved NIW profile look like in a non-research field?

There is no single approved NIW profile. Strong cases can look different depending on the field, the proposed endeavor, the applicant’s career stage, and the kind of evidence available.

25How do I know if my NIW profile is strong enough?

The best way to evaluate NIW strength is to look at the proposed endeavor, the national importance of the work, the applicant’s qualifications, and how well the evidence shows that the applicant is well positioned to advance the endeavor in the United States.
