THE DIRECT ANSWER

What is an EAD, and who needs Form I-765?

An Employment Authorization Document (EAD) is a USCIS-issued work authorization card, also known as Form I-766. Form I-765 is the application commonly used to request the first EAD, a renewal, or a replacement in an eligible category. Filing an I-765 does not create a new immigration status or guarantee an approval.

Eligibility depends on the applicant's specific category under 8 CFR 274a.12. Certain people, including some E and L spouses, may already be authorized to work incident to status and may not need an EAD as a prerequisite to employment.

Changes to the automatic-extension regulations make individualized review especially important before an EAD expires. The submission date, category, underlying status and any separate statutory or program-specific exception must be evaluated together.

COMMON WORK AUTHORIZATION CATEGORIES

The EAD category determines the legal requirements

USCIS does not treat every I-765 request the same way. Our analysis starts with the correct basis for the requested card.

ADJUSTMENT OF STATUS

Pending green card applications

Many pending Form I-485 applicants request an EAD in category (c)(9). A pending adjustment application does not, by itself, authorize employment, and an underlying case problem may affect eligibility.

STUDENTS

F-1 OPT and STEM OPT

Training authorization depends on F-1 rules, a school recommendation, eligible employment and USCIS approval. A timely STEM OPT extension can have a separate 180-day rule.

DEPENDENT SPOUSES

H-4 employment authorization

Qualifying H-4 spouses may apply for category (c)(26) employment authorization, subject to eligibility connected to the principal H-1B. H-4 status alone does not grant work authorization.

HUMANITARIAN CATEGORIES

Asylum and TPS

Asylum applicants, asylees and TPS beneficiaries follow distinct statutory and regulatory frameworks, including differences between an underlying authorization and an EAD as evidence.

2026 RENEWAL RULES · IMPORTANT CHANGE

Do EAD renewals still receive an automatic extension?

For most EAD renewal applications filed on or after October 30, 2025, the answer is no. DHS ended the general regulation-based automatic extension arising from the filing of Form I-765. A renewal receipt by itself generally does not extend EAD validity or authorize continued work after the existing authorization expires.

Earlier eligible filings: Some renewal applications properly filed before October 30, 2025 remain subject to the previous up-to-540-day automatic extension rules under 8 CFR 274a.13(d), if all eligibility conditions are satisfied.

Separate exceptions: Some TPS-related extensions arise by law or Federal Register notice. A timely STEM OPT extension application may qualify for a distinct 180-day extension. Work authorization incident to valid status is another separate legal question.

The October 14, 2026 DHS final rule retained this approach. Employers and employees should evaluate the exact dates and acceptable evidence instead of assuming that a pending renewal extends eligibility.

STATUS-BASED WORK AUTHORIZATION

An EAD is not always required to work legally

Eligible E and L spouses

Certain E-1, E-2, E-3 and L-2 spouses are authorized to work incident to qualifying nonimmigrant status. Codes such as E-2S and L-2S on an unexpired I-94 can help document that authorization.

H-1B and other work classifications

Qualifying work status can allow employment in the specific authorized job without a separate EAD. That is not necessarily unrestricted permission to work for another employer.

H-4 and many adjustment applicants

An eligible H-4 spouse generally needs approved EAD authorization to work. Many pending adjustment applicants also need their approved (c)(9) EAD unless they hold a separate valid work authorization.

F-1 and program conditions

Certain F-1 activities and on-campus employment have distinct rules; post-completion OPT and STEM OPT depend on the relevant approval and training requirements. An EAD's dates are not the only restriction.

When an EAD problem threatens your ability to work

RENEWAL

Expiring EAD and pending I-765

Evaluate the current card, renewal filing date, legal category and any other authorization. An early filing reduces timing risk but does not guarantee continuous work eligibility.

EXPEDITE

Processing delays and urgent circumstances

USCIS expedite requests require circumstances that fit current criteria and persuasive supporting documentation. Delays and financial concerns require individualized assessment.

EVIDENCE

RFE or Notice of Intent to Deny

Requests concerning identity, immigration status, eligibility category or supporting evidence may be challenged on their actual facts and applicable regulations.

RFE legal representation ↗
CARD ISSUE

Lost, incorrect or undelivered EAD

Replacement and correction options depend on whether USCIS made an error, the mailing history and what happened to the issued document.

CHALLENGE AN ERRONEOUS FINDING

Contest an incorrect EAD denial or work authorization determination

An adverse I-765 decision may rest on a disputed eligibility category, incorrect assessment of the underlying petition, an overlooked I-94 or status document, or inaccurate employment authorization dates. An experienced immigration attorney can assess whether the government applied the correct legal standard and considered the material evidence.

Where warranted, our firm evaluates opportunities to challenge, clarify or request reconsideration of an unsupported USCIS conclusion, or to pursue a legally appropriate alternative application. The availability of review differs by EAD category and decision; there is no universal appeal route for every I-765 denial.

We also evaluate incorrect employer documentation conclusions and disputes about prior automatic extensions or work permission incident to status. An inaccurate underlying finding should not be conceded merely to obtain a replacement card.

FREQUENTLY ASKED QUESTIONS

EAD and Form I-765 FAQs

Employment authorization, 2026 automatic-extension rules, eligibility categories, renewals, delays, denials and employer documentation.

What is an Employment Authorization Document (EAD)?

An EAD, also called Form I-766, is evidence of employment authorization issued by USCIS to eligible individuals. Its validity and permitted work depend on the legal category and any applicable special rules.

What is Form I-765?

Form I-765 is the application used by eligible applicants to request initial employment authorization, renew employment authorization documents or replace certain cards. It is not an independent immigration status.

Who is eligible to request an EAD?

Eligibility is determined by a specific employment authorization category under 8 CFR 274a.12. Common examples include certain adjustment applicants, asylum applicants, TPS applicants, eligible H-4 spouses and F-1 students requesting OPT.

Does every person who can work in the US need an EAD?

No. Some people are authorized to work incident to status or through their approved employment classification and do not need a separate EAD. The required documents and employer verification rules differ.

What does the category code on an EAD mean?

The eligibility code, such as (c)(9) or (c)(26), identifies the regulatory basis for employment authorization. Category matters for renewals, evidence, work restrictions and any exceptions.

When can I renew my EAD?

Many categories permit renewal applications up to 180 days before expiration, but permitted filing windows and evidence requirements differ. Earlier filing does not guarantee approval before the current card expires.

Does filing an I-765 renewal automatically extend my work permit in 2026?

Generally no for renewal applications filed on or after October 30, 2025. DHS ended the general renewal-based automatic extension, subject to older qualifying filings and distinct extensions provided by law or eligible TPS Federal Register notices.

Can a renewal filed before October 30, 2025 still receive the older automatic extension?

Some timely, otherwise qualifying renewal applications filed before October 30, 2025 can remain covered by the older 8 CFR 274a.13(d) framework. Eligibility, matching category, filing date and I-9 documentation must be reviewed.

Does the new 2026 EAD rule affect TPS automatic extensions?

Some TPS-related documentation remains subject to separate statutory or Federal Register extension mechanisms. A particular designation notice, category and effective date control; there is no universal TPS extension.

Can I work while my renewal is pending?

Only if another valid authorization, still-valid EAD, qualifying earlier automatic extension or separate exception applies. A pending I-765 receipt by itself is not a general authorization to work.

Is a timely STEM OPT application an exception?

Eligible F-1 students who timely file for the 24-month STEM OPT extension may receive a distinct 180-day extension of employment authorization while the application is pending, subject to its special requirements.

Can I work immediately after applying for initial OPT?

Ordinarily no. Post-completion OPT employment generally requires USCIS approval and the authorized dates, and the student must meet current F-1 and training rules. Filing I-765 is not itself employment authorization.

Does an adjustment of status applicant automatically have permission to work?

Not merely because Form I-485 was filed. Many applicants request an EAD under category (c)(9); others may have independent work authorization, such as a qualifying nonimmigrant employment status.

Are H-4 spouses authorized to work incident to status?

No. Certain H-4 dependent spouses may qualify to request an EAD under category (c)(26), but H-4 status alone is not the same as work authorization incident to status.

Do E-2 or L-2 spouses need an EAD?

Certain E and L dependent spouses are employment authorized incident to qualifying status. An unexpired I-94 showing E-1S, E-2S, E-3S or L-2S can be relevant documentation; other situations need individual review.

Can an EAD be used to work for any employer?

Many EAD categories are not tied to a specific employer, but some categories, such as OPT and STEM OPT, involve training, reporting, employer or program conditions. The precise authorization basis controls.

What if my EAD is expiring before USCIS decides the renewal?

Review the filing date, category, I-94, possible statutory extensions and any other work authorization immediately. Counsel can assess lawful alternatives and expedite criteria; approval by an expiration date cannot be promised.

How long does USCIS take to process Form I-765?

Processing times vary by eligibility category, USCIS workload, case facts and the current reporting system. No fixed timeframe applies to every applicant; current USCIS estimates must be checked for the particular filing.

When may USCIS expedite an EAD case?

USCIS considers qualifying expedite requests case by case under current criteria, including certain urgent humanitarian circumstances or severe financial loss. A job offer or inconvenience alone does not guarantee expedition.

Can an incorrect EAD or card production error be corrected?

Often yes, but the available correction or replacement procedure depends on whether USCIS made the error and whether the original card was lost, stolen, damaged or issued with inaccurate information.

What if USCIS says the EAD was mailed but I never received it?

The mailing record, delivery tracking, address history and USCIS notices should be examined to determine whether the situation is a nondelivery issue or a replacement request.

What if my Form I-765 receives an RFE?

An RFE identifies an eligibility or evidentiary issue to address. The requested category, underlying immigration record, notice terms and supporting documents must be evaluated; failure to resolve the issue may result in denial.

Can a denied EAD application be challenged?

Available review differs by decision and category. An attorney may examine a potentially incorrect legal or factual finding, assess any available motion or reconsideration option, or consider a new application when legally appropriate.

Does an EAD grant lawful immigration status?

No. An EAD establishes employment authorization for the applicable category and period; it does not, by itself, confer lawful nonimmigrant status, permanent residence or permission to travel internationally.

Can I file Form I-765 online?

Online filing is available for some, but not all, eligibility categories and circumstances. USCIS instructions and category-specific requirements determine whether electronic filing is available.

When should I consult an EAD immigration lawyer?

Consider legal review when employment authorization may lapse, the category or underlying status is uncertain, USCIS issued an RFE or denial, an expedite request is needed, or employer I-9 documentation is contested.
