THE LEGAL STARTING POINT

What is a B-2 visa and who may qualify?

B-2 is a temporary visitor classification for permissible pleasure travel. Tourism, visiting friends or family and receiving certain medical treatment are common examples. The applicant must establish the purpose, intention to return after the temporary stay, and independent eligibility under applicable immigration law.

Issuance of a visa and admission to the US are different decisions. A visa allows a traveler to ask CBP for entry; the I-94 or other lawful admission record identifies the period actually permitted.

A visitor visa is not permission to live or work in the United States.

For many clients, the hard question is not whether the visit sounds reasonable. It is whether the full personal, travel and immigration history supports the classification sought.

PERMITTED VISITOR PURPOSES

Common B-2 tourist and personal visits

Activities are evaluated according to their actual purpose and whether they are consistent with visitor status.

VISITOR CATEGORY

Tourism and vacations

Sightseeing, holidays and leisure travel within an authentic, temporary visitor itinerary.

VISITOR CATEGORY

Visits to family and friends

Temporary personal visits, reunions, and family occasions, without a plan to relocate under visitor status.

VISITOR CATEGORY

Medical treatment

Eligible temporary care supported by treatment arrangements, estimated expenses and credible funding.

VISITOR CATEGORY

Social and personal events

Certain reunions, ceremonies and social gatherings consistent with permissible visitor activity.

VISITOR CATEGORY

Short recreational classes

Limited, avocational instruction incidental to tourism, distinguished from full academic study.

VISITOR CATEGORY

Combined B-1 / B-2 travel

A combined visa may support either permitted business or tourism activities, depending on the real purpose of admission.

A family relationship, medical appointment or invitation letter does not by itself establish qualification or guarantee a visa. Relevant facts vary by traveler.

WHAT THE CLASSIFICATION DOES NOT AUTHORIZE

Understand the limits of B-2 visitor status

An otherwise legitimate visit can become problematic when the traveler intends to work, study, remain for extended periods, or has a conflicting immigration history.

Employment or productive services

B-2 is not a work visa. A short trip and offshore pay do not automatically authorize labor or services from US territory.

Long stays that resemble residence

Frequent or extended visits may raise questions about a person’s principal residence, financial support and temporary intentions.

Misstated purpose or changed plans

Inaccurate statements and material inconsistencies can create consequences far beyond an ordinary INA 214(b) refusal.

Studying or medical travel without preparation

Degree study usually requires another classification; substantial medical treatment requires an intelligible treatment and funding plan.

Does your proposed visit raise immigration concerns?Request a confidential consultation ↗

VISITING FOR TREATMENT

Medical treatment under a B-2 visa

Qualifying medical treatment is a recognized visitor purpose. More substantial visits call for clarity about the proposed care, anticipated duration, expenses and ability to depart after treatment.

MEDICAL PURPOSE

Treatment plan

Diagnosis, proposed care, medical correspondence and a provider’s estimated treatment schedule where available.

FINANCIAL CAPACITY

Realistic payment arrangements

Supporting evidence of medical costs, travel, accommodation and means of covering the expected expenses.

TEMPORARY STAY

Expected duration

A credible plan for an authorized visit and arrangements to return abroad following the treatment.

Travel primarily intended to obtain US citizenship for a child through giving birth in the United States is not an allowable basis for B visa issuance. Legitimate medical care and individual circumstances require careful legal analysis.

DOCUMENT A TEMPORARY VISIT

What evidence supports a B-2 visitor application?

Purpose and itinerary

Dates, locations, event or family visit details, reservations where appropriate and a candid description of the trip.

Life outside the US

Employment or business, residence, household obligations and other material circumstances supporting an intended departure.

Expenses and support

Reasonable trip budget, source of funds and, where applicable, credible arrangements for medical costs.

Prior immigration history

Previous visas, travel, admissions, extensions, refusals and any unexplained or inconsistent statements that warrant review.

VISA REFUSALS, REVOCATIONS AND ADMISSION CONCERNS

An adverse visitor visa finding deserves a focused legal review

Consular refusals and airport decisions have different legal consequences. We examine the actual ground, relevant records, inconsistencies and the possibility of challenging an unsupported finding or presenting a stronger application.

INA 214(b)

Failure to establish visitor qualification or overcome the applicable immigrant-intent presumption. The reasons for travel, ties and prior application record should be evaluated.

INA 221(g)

Documentation or administrative processing may prevent issuance at the time of interview. A 221(g) refusal is distinct from a substantive inadmissibility finding.

INA 212(a)

Specific criminal, fraud, unlawful presence or other inadmissibility grounds call for separate factual and legal assessment. Certain grounds may have discretionary waiver options.

Review INA 212 issues ↗

CBP or visa revocation

Border inspections, prior activities and a visa revocation may create concerns separate from the initial visitor application. The agency’s actual record matters.

Airport denials ↗

We help assess potential factual or legal errors without promising that any particular visa issuance, waiver, admission, challenge or processing timeline will succeed.

FREQUENTLY ASKED QUESTIONS

B-2 Tourist Visa FAQs

Answers on visits, restrictions, medical travel, immigration history, denials and border admission.

What is a B-2 tourist visa?

A B-2 is a nonimmigrant visitor classification for eligible temporary pleasure travel, such as tourism, visiting family and friends, or certain medical treatment. It does not provide permanent residence or ordinary US employment authorization.

What activities are permitted on a B-2 visit?

Common qualifying activities include vacations, sightseeing, visits to relatives or friends, certain social events and eligible medical treatment. The trip must remain consistent with visitor status and the authorized admission.

Can I use a B-2 visa to visit my spouse or children in the US?

Potentially. Visiting family may be a legitimate purpose, but the applicant must still establish the temporary nature of the visit and applicable eligibility. A close US family relationship can be relevant to the immigrant intent assessment.

Can my US citizen fiancé or spouse sponsor me for a B-2 visa?

A visitor visa is not ordinarily granted through a family sponsorship petition. An invitation can help explain the visit, but the applicant must independently establish visitor eligibility and intended temporary travel.

Can I visit my partner in the United States while an immigrant petition is pending?

A pending or approved immigrant petition does not automatically bar a B-2 visit, but it may intensify scrutiny of whether the proposed trip is genuinely temporary. Statements and travel plans must be truthful and consistent with the applicant’s actual intentions.

Can I work remotely while visiting on a B-2 visa?

B-2 is not a general remote work authorization. Performing employment or providing productive services while physically present in the United States can create status issues even if wages are paid abroad. The planned activity should be reviewed individually.

Can I look for a job during a B-2 visit?

Some preliminary exploration, interviews or meetings may be possible depending on their nature, but B-2 does not ordinarily authorize starting work, trial shifts or productive employment. A different status and appropriate authorization may be necessary before employment.

Can I study on a B-2 visa?

Ordinary academic study generally calls for the appropriate student classification. Limited recreational, avocational study incidental to a visit may be permissible, but B-2 should not be used to begin a degree or other substantive academic program.

Can I enter the US for medical treatment on B-2?

Certain temporary medical treatment is a recognized visitor purpose. The applicant may need medical diagnosis or treatment information, provider arrangements, expected duration, proof of payment and evidence of plans to depart.

Does B-2 cover giving birth in the United States?

Travel whose primary purpose is obtaining US citizenship for a child through birth in the United States is not an allowable basis for B visa issuance. Legitimate medical treatment questions and the traveler’s actual purpose require careful, truthful assessment.

How much money do I need for a B-2 visa?

There is no universal statutory bank balance that guarantees a visa. An applicant should be able to explain and document a realistic trip budget, funding source, and ability to cover personal expenses or medical costs where applicable.

Do I need an invitation letter from my family member?

An invitation can support the stated purpose, but it is not an immigration status guarantee and is not a substitute for the applicant’s own eligibility, temporary intentions and overall circumstances.

What evidence can help establish strong ties abroad?

Relevant circumstances vary but may include sustained employment, business ownership, residence, family responsibilities, financial commitments and a credible reason to return. No single document automatically resolves an INA 214(b) concern.

Why was my tourist visa refused under INA 214(b)?

A consular officer may conclude the applicant has not shown eligibility for a temporary visitor visa or has not overcome the applicable presumption of immigrant intent. The precise facts, prior answers and reasons for travel matter.

Can I appeal an INA 214(b) refusal?

There is generally no formal administrative appeal of a consular INA 214(b) refusal. A new application may be possible, especially where material circumstances or supporting facts have changed. Counsel can evaluate factual errors and suitable avenues for further consideration.

What is INA 221(g) administrative processing?

INA 221(g) means the visa cannot be issued at that stage, commonly because additional documents or administrative review are required. It is not the same legal finding as INA 214(b) or a specific INA 212(a) inadmissibility ground.

Does a ten-year B-2 visa let me stay for ten years?

No. The visa validity period concerns when the holder may seek admission. CBP separately sets the authorized period for each admission, generally recorded on Form I-94. A multiple-entry visa does not confer permission to live in the United States.

Can I stay for six months on every B-2 trip?

Not necessarily. Many visitor admissions are for up to six months, but CBP determines the authorized length of each stay. The admission record, not a general assumption or the visa expiration date, controls.

Can I apply to extend my B-2 stay?

Certain B-2 visitors may be eligible to request an extension using Form I-539, subject to timely filing and other conditions. An application does not itself authorize prohibited employment or guarantee approval. Review the I-94 and the individual circumstances.

Can I change from B-2 to F-1 or another status?

A change of status may be possible for some individuals who qualify and satisfy the governing requirements. Timing, prior intent, maintenance of status and restrictions on starting study or work require case-specific review.

Is a B-2 visa the same as ESTA?

No. ESTA is a travel authorization for eligible Visa Waiver Program travel, not a B-2 visa. The permitted length of admission and extension, change of status and review rules can differ materially.

What happens if CBP refuses me entry with a B-2 visa?

A visa does not guarantee admission. CBP can question the purpose of travel and examine admissibility; the outcome may involve withdrawal of an application for admission, expedited removal or other action depending on the facts and applicable authority.

Can a past overstay affect a new tourist visa?

Yes. Overstays, prior status violations and unauthorized employment can lead to additional scrutiny or inadmissibility issues. The number of days, admission terms, and applicable law must be examined before advising on travel.

Can a prior arrest or inaccurate visa application cause a B-2 denial?

Yes. Criminal history, prior statements, material misrepresentation and other inadmissibility issues can affect eligibility. An arrest does not necessarily establish a particular inadmissibility ground; the exact disposition and legal classification matter.

Are waivers available after an INA 212(a) tourist visa refusal?

Certain grounds may be eligible for a discretionary nonimmigrant waiver under INA 212(d)(3), depending on the ground and facts. A waiver is separate from the requirement to qualify for the B-2 classification and cannot be assumed available for every case.

When should I consult a B-2 visa lawyer?

Consider legal review when there has been a 214(b) refusal, lengthy administrative processing, a prior overstay, an accusation of unauthorized work, a CBP problem or an inaccurate inadmissibility finding, or when travel plans raise unusual eligibility questions.
