International recognition
The individual must be recognized internationally as outstanding in a specific academic field. Evidence is evaluated in context, including its significance, independence and reach beyond one institution.
EB1 · OUTSTANDING PROFESSORS AND RESEARCHERS
A detailed guide to international academic recognition, the six evidence criteria, three years of qualifying experience, and employer sponsored permanent research or teaching positions.
EB1B can support an immigrant petition without PERM labor certification when the academic achievements and qualifying job offer meet the requirements.
A strong filing explains not only the researcher’s achievements, but why the total record demonstrates international recognition as outstanding.
EB1B OUTSTANDING PROFESSORS AND RESEARCHERS
EB1B permits a qualifying US employer to petition for an outstanding professor or researcher whose work has earned international recognition in a defined academic field. The category connects two essential parts of the case: the researcher’s achievements and the employer’s qualifying offer of a permanent academic or research position.
It is not limited to people with a particular degree, a specific number of citations, or a single research discipline. The record must establish the applicable statutory and regulatory requirements, including at least two of the six evidentiary criteria and international recognition as outstanding when all the evidence is considered together.
Discuss an EB1B petitionTHE LEGAL FRAMEWORK
Successful preparation begins with the correct legal questions, not with a citation total or a generic checklist.
The individual must be recognized internationally as outstanding in a specific academic field. Evidence is evaluated in context, including its significance, independence and reach beyond one institution.
At least three years of teaching or research experience in the academic field must be demonstrated. Special rules apply to experience obtained while working toward an advanced degree.
The employer must offer an eligible tenure or tenure track teaching role or a qualifying permanent research role in the beneficiary’s academic field, as appropriate to the employer type.
THE SIX REGULATORY CRITERIA
At least two criteria must be supported under 8 CFR 204.5(i)(3)(i). Comparable evidence may be permitted where the listed standards do not readily apply. Meeting the numerical threshold does not eliminate USCIS’s final assessment of international recognition.
Show that the award recognizes outstanding achievement in the academic field, rather than mere participation or ordinary performance. Explain the selection process, the caliber of recipients, and the award’s standing in the field.
Useful exhibits: Award announcement, rules, selection committee, prior recipients, institutional materials and independent reporting.
The relevant association or membership grade must require outstanding achievement. General dues based membership or membership obtained solely through professional status usually requires additional analysis.
Useful exhibits: Bylaws, fellowship or membership admission standards, nomination process, selection records and evidence of competitive selection.
Qualifying material must be written by others, concern the applicant’s work in the academic field and appear in professional publications. Include title, date and author, with a translation when necessary. A standard citation listing alone does not necessarily establish this criterion.
Useful exhibits: Independent profiles, research reporting, scholarly commentary and publication circulation evidence.
Document participation as a judge of the work of others in the same or allied academic field. The record should identify the substance of the judging work, such as peer review of manuscripts, grants or conference submissions.
Useful exhibits: Invitations, completed review confirmations, editor or program chair letters, reviewer dashboards and evaluation records.
Explain what was original and what the applicant actually contributed. Strong evidence connects the work to its effect on the academic field through independent adoption, use, follow on research or persuasive expert analysis.
Useful exhibits: Publications, patents or methods in use, independent references, implementation records and detailed expert letters grounded in concrete examples.
Show authorship of scholarly books or articles in scholarly journals with international circulation in the relevant academic field. The petition should identify the publications, their scholarly nature and international reach.
Useful exhibits: Article first pages, books, bibliographic records, journal publisher information and indexing or circulation documentation.
Authority: INA 203(b)(1)(B); 8 CFR 204.5(i)(3)(i) and (ii).
THE THREE YEAR RULE
Experience must be in the relevant academic field and should be established through specific letters from current or prior employers describing duties and dates.
Qualifying teaching or research experience may arise from university appointments, postdoctoral employment, research institute positions or other documented research work. The job title alone does not determine whether the work qualifies.
Degree period experience is subject to a special rule. The degree must have been obtained and, in addition, qualifying teaching must involve full responsibility for the class taught, or research toward the degree must have been recognized within the academic field as outstanding.
THE EMPLOYER AND JOB OFFER
The petitioning employer’s legal eligibility and the position’s structure are as important as the academic record.
A US university or institution of higher learning may offer a tenured or tenure track teaching position in the relevant academic field. The appointment letter, academic rank and department responsibilities should be clear.
Universities may sponsor qualifying permanent research positions. A permanent research position may be of indefinite or unlimited duration with an ordinary expectation of continued employment absent good cause for termination.
A department, division or institute of a private employer may qualify if it offers a permanent research role, has at least three persons employed full time in research positions, and documents its academic field accomplishments.
BEYOND METRICS
USCIS reviews whether the evidence satisfies specific regulatory descriptions and then considers the petition as a whole. Strong records connect raw exhibits to the applicant’s individual accomplishments.
Identify significant work, field relevant citation patterns and independent use. Explain authorship, contribution and influence without suggesting that a numerical threshold guarantees approval.
Document completed evaluation work, not invitations alone. Describe the journal or organization’s standing and the nature of the applicant’s responsibility.
Explain the adoption of techniques, independent replication, use of software or methods, funded applications, clinical or industrial implementations, and other concrete research effects.
Use detailed letters that describe what the applicant personally accomplished, why it matters and how independent researchers or institutions relied on the work.
Align the field used in the petition with the offered position and the applicant’s recognition. Avoid an overly broad field that dilutes the evidence or an artificially narrow field.
First identify evidence meeting the criteria; then demonstrate international recognition as outstanding through the totality of the evidence. Do not mistake a criteria count for a merits determination.
TYPICAL EB1B SETTINGS
These are hypothetical examples, not reports of firm case outcomes. Each depends on the actual documents and full legal record.
An incoming professor has documented independent research recognition, scholarly authorship and peer review service. The university offers a tenure track position in the same academic field and documents three qualifying years of experience.
A scientist has published influential work and led original research. The institution offers a permanent research appointment, while the petition explains both field recognition and the job’s expected continuing duration.
A private employer identifies a qualifying research division and its documented accomplishments, demonstrates the minimum full time research staffing, and offers a permanent role supported by the beneficiary’s academic record.
COMMON RFE CONCERNS
The petition lists citations, conference talks and impressive positions without connecting them to sustained, meaningful recognition as outstanding in the academic field.
The university or private employer submits a generic appointment letter that does not establish the qualifying employment category or permanent research character.
Years spent obtaining a degree are included without addressing the special teaching responsibility or outstanding research recognition standard.
Ordinary association memberships, articles authored by the beneficiary rather than written about the beneficiary, or review invitations without evidence of judging may not establish the criterion claimed.

FROM STRATEGY TO PETITION
Define the academic field, calculate qualifying experience, examine the proposed job and identify the strongest evidentiary criteria.
The employer assembles the offer, employer qualification documents, supporting exhibits and narrative showing why the beneficiary is outstanding.
Approved immigrant classification alone does not grant permanent residence. Adjustment of status or consular processing depends on visa availability and individual eligibility.
QUESTIONS AND ANSWERS
Common issues involving qualification, publications, experience and employer sponsorship.
No. The category does not impose a blanket PhD requirement. The evidence must establish outstanding international recognition, qualifying experience and an eligible offered position. Special conditions apply if experience while pursuing an advanced degree is used.
No. A qualifying US employer files the I140 petition. EB1A and EB2 NIW may permit self petitioning under their separate legal standards.
No. EB1B is exempt from the PERM labor certification requirement, but the employer must provide the qualifying offer and establish its ability to pay the offered wage.
There is no fixed regulatory minimum. Qualifying authorship and any citation evidence should be analyzed in the context of the field and the entire record.
Actual judging may support one criterion. EB1B requires at least two criteria or appropriate comparable evidence, together with all other requirements and a favorable final merits determination.
Only under the regulatory special rule: the advanced degree must have been acquired and qualifying teaching must include full class responsibility, or research performed toward the degree must have been recognized as outstanding in the academic field.
It may qualify when the research is in the academic field and adequately documented. The precise duties, dates and relationship to the claimed field matter.
Yes, through a qualifying department, division or institute with a permanent research position, at least three full time research personnel and documented accomplishments in an academic field.
A fixed term position with no ordinary expectation of continued employment may not meet the permanent research position standard. The actual terms and reasonable expectation of continued employment require review.
No. A university may offer a qualifying permanent research position without tenure, provided the regulatory definition of permanence and other requirements are met.
No particular named prize is mandated. The awards criterion refers to major prizes or awards for outstanding achievement in the academic field. The standing and selection process of an award matter.
No. Form I140 approval establishes immigrant classification. Permanent residence additionally requires visa availability and eligibility for adjustment of status or an immigrant visa.
Separate employment based immigrant petitions may be pursued if the applicable requirements are satisfied. The filing and residence processing strategy should be coordinated carefully.
USCIS first assesses whether regulatory evidence criteria are met, then conducts a final merits determination considering whether the evidence as a whole establishes the necessary outstanding international recognition.
Typical evidence includes the offer letter, position description, institutional records, payroll or organizational evidence where relevant, accomplishments of the research unit and ability to pay materials.
Respond to the notice’s precise concerns with relevant documentation and a focused legal analysis. A successful response must address both the claimed criteria and any broader recognition, experience or employer issues identified.
