Eligibility tied to the TN principal

TD classification is available to qualifying spouses and unmarried children under 21 of a TN professional. A dependent does not need the same citizenship as the TN principal, but nationality can affect whether the person needs a visa at a US consulate.

Evidence usually includes the relationship, proof of the principal's valid TN status, employment and admission record, and each dependent's passport or other required travel documentation.

TD nationality requirements can differ from the TN professional's. Canadian citizens are generally visa-exempt for TD admission, while Mexican citizens and non-Canadian dependents ordinarily need a TD visa unless a separate exemption applies. A non-Canadian spouse of a Canadian TN worker should not assume the Canadian visa exemption extends to them.

TD employment is not authorized

A TD spouse cannot work in the US simply because the TN principal is employed. Employers may not treat TD as an incident-to-status work classification comparable to L-2S or qualifying E spouses.

A family member who wants employment should evaluate separate eligibility for TN or another work-authorized classification. Some dependents may qualify independently, but their own citizenship, profession and job duties would then matter.

TD status does not provide employment permission for a dependent spouse. A spouse seeking work may need a separately available category, potentially including independent TN classification if that spouse independently meets the professional, citizenship and job requirements.

Education and student-age children

TD spouses and eligible children may generally attend school full time or part time while maintaining TD status, including children attending school and adults enrolling in academic programs.

Study rights should not be confused with permission to work in an internship, clinical rotation or job integrated into a program. Any activity that amounts to employment requires a separate assessment.

A TD spouse or child can pursue permitted educational activities, including schooling where allowed, but educational enrollment does not convert TD into a work-authorized status. A child nearing 21 should consider independent classification options before the TD age limit is reached.

Visa processing, changes and travel

A person already in the US may qualify to request TD status or an extension on Form I-539; the principal's TN status and the dependent's I-94 dates are important. Travel can also involve consular visa procedures for those who are not visa-exempt.

A Canadian TN principal, a Mexican TN principal, and dependents with another nationality may face different document and visa requirements. Plan the family's route and timing together.

A TD application or inspection packet may include the principal's TN admission record, job offer or employment verification, the marriage or birth certificate and financial support evidence. Some dependents need a visa from a consulate, while others may seek TD admission directly at a port of entry.

After a principal TN employer change or extension, check both the worker's and each dependent's I-94 and any Form I-539 notices. Continuing TD eligibility depends on the principal's qualifying TN status, not simply an unexpired visa foil.

Questions and answers

Frequently asked questions about TD dependent visa

Concise answers to common issues. Individual facts and immigration records can change the result.

Can a TD spouse take a US job?

No. TD status does not independently authorize employment. The spouse would need a separate classification or other employment authorization.

May a TD child attend school in the US?

Yes. Eligible TD children may generally study while maintaining dependent status.

Does every Canadian TD applicant need a visa stamp?

Visa requirements depend on nationality and applicable exemptions. Canadian nationals frequently have different documentation rules from dependents of other nationalities.

Can a TD spouse apply for TN independently?

Potentially, if that spouse independently meets TN eligibility, including citizenship, profession and a qualifying US position; TD status alone does not confer TN eligibility.

Does a Canadian citizen TD spouse always need a TD visa?

Canadian citizens are generally visa-exempt for TD classification and may seek admission with supporting evidence. Other nationalities, including many spouses of Canadian TN professionals, ordinarily need a TD visa unless exempt.

Does a Mexican citizen TD dependent need a consular visa?

Mexican nationals ordinarily require a TD visa before admission. The principal's TN documents and proof of the family relationship are central to the application.

Can a TD spouse qualify for their own TN status?

Potentially, if the spouse independently holds qualifying Canadian or Mexican citizenship, has an eligible professional position and meets the requirements of the separate TN classification.

What documents are useful when following a TN professional to the US?

Often the principal's valid I-94 and employment records, marriage or birth evidence, the dependent's passport and a TD visa when required. The exact requirements vary by nationality and place of application.
