Who qualifies for M-2 dependent status?

M-2 is the dependent classification for the spouse and unmarried children under 21 of a qualifying M-1 vocational student. It is different from F-2, which is associated with an F-1 academic student. A family member does not become an M-2 dependent merely because the principal is studying in the US; the principal's actual immigration classification matters.

An M-2 applicant generally needs evidence of the relationship, the M-1 student's status or planned enrollment, and a separate Form I-20 issued for the dependent by the school's designated school official. The relevant SEVIS information, passport, visa requirements and travel history should be reviewed together. The M-1 principal must continue to maintain the conditions of the student's status.

Can an M-2 spouse or child work in the US?

M-2 status does not authorize employment, whether the dependent is a spouse or child. An M-2 dependent should not begin paid work or assume that an employment authorization document is available simply because the principal student has permission for a particular activity. Any potential independent employment or status pathway requires separate analysis.

M-2 study rules for spouses and children

Children in M-2 status may generally attend elementary or secondary school full time. M-2 spouses and older children may pursue part-time study within the applicable limits; a full course of postsecondary or vocational study ordinarily requires an appropriate change of status before beginning that program. The specific program, course load and age of the dependent matter.

A dependent planning a full-time college or vocational program should speak with the school and immigration counsel before enrollment. A change of status filing does not automatically authorize the proposed course of study while that application is pending. Study permission is separate from permission to work.

Travel, status extensions and aging out

An M-2 dependent's lawful stay depends on the principal M-1 student's qualifying status and the dependent's own admission record. Extensions or changes of status, where eligible, commonly involve Form I-539. A status approval within the US is not a substitute for a required consular visa when returning from travel abroad.

Changes to the principal student's program, interruption of M-1 status, departure or a dependent child's 21st birthday can require additional planning. The family's current Forms I-20 and I-94, school records and proposed itinerary help establish the appropriate next step.

When to consult an immigration attorney

We assist families preparing initial M-2 visa applications, reviewing possible I-539 filings, planning school attendance, responding to status concerns and evaluating the transition to an independent immigration status. A consultation can identify which rules apply to the principal and each dependent before the family makes travel or enrollment commitments.

M-2 dependent visa questions

Is M-2 the same as F-2?

No. M-2 depends on an M-1 vocational student, while F-2 depends on an F-1 academic student. The student's classification determines the dependent category and can affect study and status planning.

Can an M-2 spouse work with an EAD?

Employment is not authorized based on M-2 status. A separate independent legal basis would be required before employment may begin.

Can an M-2 child attend public school?

An eligible M-2 child can generally attend elementary or secondary school. Different rules govern postsecondary or vocational education, including full-time enrollment.

Can an M-2 dependent enroll in college full time?

M-2 generally permits part-time postsecondary study within the applicable limits; full-time postsecondary study generally requires changing to an appropriate student classification before starting the program.
