ESTA DENIED OR REVOKED · VISA WAIVER PROGRAM COUNSEL

ESTA and Visa Waiver Program Lawyer for Denials, Revocations and Travel Issues

ESTA is permission to seek short-term travel under the Visa Waiver Program, not a US visa or a guarantee of admission. Our firm evaluates complicated travel records, denied or revoked ESTA authorizations, and options for visitors who cannot use visa-free travel.

A DIRECT ANSWER

What is ESTA, and what does it actually permit?

The Electronic System for Travel Authorization (ESTA) is an advance screening system administered by US Customs and Border Protection for travel under the Visa Waiver Program (VWP). Many eligible travelers can seek admission without first obtaining a visitor visa for short qualifying business or tourism trips.

Travel authorization and lawful admission are separate decisions. An approved ESTA generally supports travel to a US port of entry, where CBP determines admissibility and any permitted period of stay. ESTA itself is not work authorization, not a visa, and not residence in the United States.

Three separate decisions

ESTA: advance travel authorization. Visa: a separate consular process for applicants who need or choose one. Admission: CBP's decision at the border. Confusing these can produce serious errors in a future application or legal challenge.

VISA WAIVER ELIGIBILITY

Who qualifies for ESTA travel?

A participating-country passport is only the starting point. A traveler must independently satisfy the program's document, travel, admission and security requirements.

NATIONALITY AND DOCUMENTS

Eligible passport

Appropriate nationality and a qualifying electronic passport, including additional rules for dual nationality or a changed passport.

PURPOSE AND DURATION

Business or tourism

A bona fide temporary visit for allowable activities, normally lasting no more than 90 days; neither ordinary US employment nor residence is authorized.

SCREENING AND HISTORY

Disqualifying circumstances

Previous refusals, removals, criminal issues, overstays and relevant international travel may require closer screening or a visa application.

SPECIAL TRAVEL HISTORY

Cuba and other countries

Specified travel to Cuba since January 12, 2021, certain other countries since March 1, 2011, and particular dual nationalities can prevent VWP use, subject to limited exceptions.

CARRIER AND ENTRY

Air, sea and land

ESTA is generally required before travel under the VWP, including eligible land arrivals. The carrier and mode of travel can affect which rules apply.

AFTER AUTHORIZATION

Changes must be reviewed

A new passport, changed name or citizenship, or certain material circumstances can make a prior authorization unusable and require a new assessment.

The official list of participating countries and eligibility exceptions can change. We examine the applicable rules at the time of the proposed trip.

BEFORE AND AFTER ENTRY

The 90-day limit, authorized activities and border scrutiny

90 days is not a renewable entitlement

VWP travel normally allows no more than 90 days on admission. Short trips to Canada, Mexico or adjacent islands ordinarily do not restart the original period.

Employment and formal study

Visitor business activities are narrower than working for a US company. Full-time study and productive work usually require a different immigration classification.

Extension and status changes

VWP entrants generally cannot extend their stay or change to another nonimmigrant status. Narrow emergency or statutory exceptions should not be confused with routine eligibility.

CBP examination and travel records

CBP may examine the genuine visit purpose, overseas residence, prior travel, electronic records and admission history even when ESTA is approved.

ESTA DENIALS, REVOCATIONS AND PENDING CASES

When travel authorization is denied, identify the actual issue

A denial does not automatically establish a statutory inadmissibility finding. Decisions should be reviewed in light of immigration history, potential record inaccuracies, and the possibility of a regular nonimmigrant visa.

Authorization pending

Additional screening is ongoing. Pending status is not itself a final denial, and travel plans should not assume authorization before CBP makes a decision.

Travel not authorized

A traveler cannot rely on ESTA for the trip. A B-1 or B-2 visa may be an option, subject to independent consular eligibility and admissibility review.

B-2 visa representation ↗

ESTA revoked

A prior approval can cease to be valid because of changed facts or government screening information. The record and chronology matter before submitting new assertions.

Refusal of admission at the airport

CBP may make a separate finding or take an enforcement action at entry. The documents, officer notes and legal authority must be evaluated independently.

An ESTA denial, INA 214(b) consular refusal, and INA 212(a) inadmissibility finding are not interchangeable. Each has different legal consequences and potential remedies.

CHALLENGE ERRONEOUS RECORDS

A mistaken screening or admission record deserves careful legal review

Our firm evaluates whether a denial may rest on mistaken identity, an incomplete criminal disposition, mischaracterized travel history, incorrect immigration data, or a legally unsupported inadmissibility assessment. Appropriate review depends on the government agency and the nature of its finding.

Correct the underlying facts

Contemporaneous travel records, government notices, court dispositions and earlier visa applications may establish that the screening record is incomplete or inaccurate.

Evaluate appropriate review

Some screening concerns may warrant a redress inquiry or other agency consideration. No inquiry guarantees approval or a specific response time.

Consider a visa alternative

When VWP travel is unavailable, a regular B-1 or B-2 application can permit a distinct eligibility review. A visa is not assured merely because ESTA was refused.

Determine whether a waiver is relevant

If the underlying record establishes a particular inadmissibility ground, the potential for a nonimmigrant waiver requires separate analysis. An ESTA refusal itself has no automatic waiver category.

A legal challenge is not a promise of immediate authorization. Counsel should first establish which agency made the decision and what the actual underlying record supports.

COMPARE THE RIGHT DOCUMENT OR DECISION

ESTA, visitor visas and screening decisions

The categories below appear alphabetically, with INA provisions listed at the bottom. Each represents a distinct legal question.

FREQUENTLY ASKED QUESTIONS

ESTA and Visa Waiver Program FAQs

Direct answers to common questions about eligibility, screening denials, visits, travel history and border inspections.

What is ESTA?

ESTA is the Electronic System for Travel Authorization, a CBP screening system used before qualifying travel under the Visa Waiver Program. Approval is not a visa, an immigration status, or a guarantee of admission.

Who can apply for ESTA?

Generally, an eligible national of a participating Visa Waiver Program country with a qualifying electronic passport, a permitted temporary business or tourism purpose, and no disqualifying circumstance may request authorization. Nationality alone is not enough.

How long may I stay in the US with ESTA?

A traveler admitted under the Visa Waiver Program is generally permitted a visit of no more than 90 days. The CBP admission record governs the specific period; ESTA validity does not authorize a two-year stay.

How long is an ESTA authorization valid?

An approved ESTA is generally valid for two years or until the passport expires, whichever is sooner. A new passport or material changes in personal information or circumstances can require a new application.

Can an approved ESTA be revoked?

Yes. Authorization can be canceled or become unusable if eligibility or relevant security or immigration information changes. Travelers should verify status before departure and have a lawyer review the record if the basis is unclear.

What does ESTA authorization pending mean?

It means CBP has not yet decided the travel authorization request; it does not by itself establish ineligibility. Most determinations become available within about 72 hours, although an individual case can differ.

What happens if my ESTA is denied?

The traveler cannot rely on the Visa Waiver Program for the planned trip. Depending on the facts, counsel may review whether inaccurate records warrant inquiry, or whether a B-1 or B-2 visa application is the appropriate alternative.

Can I appeal a denied ESTA?

ESTA has no ordinary visa-style administrative appeal. Certain inaccuracies or travel-screening problems can be evaluated for available redress, but no process guarantees reversal or approval.

Can DHS TRIP correct an ESTA denial?

DHS TRIP accepts reports of potentially erroneous travel-screening decisions, including incorrect ESTA denials. Its inquiry process does not guarantee ESTA authorization or reveal every security or law-enforcement detail.

Can I reapply if an ESTA is denied?

A repeat application without changed facts may receive the same result. Any new submission must be accurate. Concealing an arrest, travel history, nationality or prior refusal can create more serious immigration consequences.

Does a prior US visa refusal affect ESTA eligibility?

It can. Previous visa refusals, admission denials, removals, overstays, or changed circumstances may be relevant to ESTA screening and eligibility. The precise history should be assessed before travel.

Can I get ESTA after traveling to Cuba?

Travel to or presence in Cuba on or after January 12, 2021 generally prevents VWP travel, subject to limited exceptions for certain official travel. A person may still pursue an appropriate US visa if otherwise eligible.

Which other travel histories can restrict Visa Waiver Program use?

Certain visits to North Korea, Iran, Iraq, Libya, Somalia, Sudan, Syria or Yemen on or after March 1, 2011 generally trigger VWP restrictions, with limited exceptions. Dual nationality in certain specified countries also matters.

Can dual citizenship affect my ESTA?

Yes. Some dual nationalities are specifically restricted under VWP law, and the citizenship and passport details on an ESTA application must be complete and accurate.

Can I use ESTA to attend business meetings?

Qualifying B-1 type temporary business activities, such as meetings or negotiations, may be permitted under the VWP. Productive employment or providing ordinary US services is generally not authorized.

Can I work remotely while in the US on ESTA?

ESTA is not employment authorization. Whether particular activities constitute unauthorized work is fact dependent, and foreign payroll or a brief visit does not automatically make work permissible.

Can I study with ESTA?

Limited incidental recreational study may be possible when consistent with visitor purposes. Full academic study or a program requiring student classification ordinarily calls for an appropriate student visa.

Can I extend my 90-day Visa Waiver stay?

VWP admissions generally cannot be extended or changed to another nonimmigrant status. Narrow emergency satisfactory-departure relief and specific statutory exceptions may apply; those are not routine extensions.

Can I change from ESTA to a work or student visa inside the US?

Visa Waiver Program entrants generally cannot change nonimmigrant status in the US. Planning to pursue employment or formal studies can require departure and an appropriate visa process.

Can I apply for a green card after entering through ESTA?

Some immediate relatives of US citizens may be able to seek adjustment notwithstanding special VWP restrictions, but facts involving admission, timing, inadmissibility, removal, and agency discretion are critical. ESTA entry does not guarantee adjustment eligibility.

Does a trip to Canada or Mexico reset the 90-day limit?

Generally not. Short trips to Canada, Mexico or nearby islands may count toward the original VWP admission period rather than starting a fresh 90 days.

Does ESTA cover entry by land?

Qualifying VWP travelers generally must obtain an approved ESTA before applying for admission at a US land border as well as before certain air or sea travel.

Can CBP deny admission when I have an approved ESTA?

Yes. CBP makes an independent admissibility determination at the border. An approved ESTA does not override a prohibited purpose, misrepresentation issue, security concern or other applicable ground.

Does an ESTA denial mean I am inadmissible under INA 212(a)?

Not necessarily. An ESTA decision and a formal inadmissibility finding are different matters. Counsel should distinguish the CBP or consular records and identify any exact statutory provision before discussing waivers.

Can a B-1 or B-2 visa be issued after an ESTA denial?

Potentially. ESTA denial is not automatically a statutory visa bar. A consular officer independently evaluates visa classification, admissibility, eligibility and the applicant’s full history; issuance is not guaranteed.

When should I contact an ESTA lawyer?

Legal review can be particularly useful after an unexplained denial, revoked authorization, CBP refusal, prior overstay, criminal matter, complicated travel history, or a suspected factual error in government records.
