Work Permit Details

Employment Authorization Document (work permit) is a document from the INS to authorize an alien to work in the US for a period of time, usually one year. This work authorization allows the work permit holder to legally work for any employer in the US.

What are the requirements for obtaining a Work Permit?

An individual can apply for a work permit in the following situations:

  • An adjustment of status applicant;
  • Spouse of an E1, E2 or L1 visa holder in the US on a derivative visa;
  • Spouse and child of a J1 visa holder;
  • Optional practical training (OPT) for postgraduate F1 students;
  • F1 and J1 students who suffer severe economic hardship;
  • K1 and K2 dependents
  • Foreign nationals under temporary protected status; and
  • Approved asylee or an asylum applicant whose petition for asylum has been pending for more than 180 days.
